Delevoz Terms of Use

These Terms of Use ("Terms") are entered into between you and Cristine Manasan, based in Barcelona, Spain, trading as "Delevoz" ("we," "us," "the Service"). By creating an account or using delevoz.com, you agree to these Terms. Who operates the site is set out in the Aviso Legal; how we handle your data is covered in the Privacy Policy — this document doesn't repeat that, it governs use of the Service itself.
1. What Delevoz is
Delevoz is an independent online practice tool for the oral component of the DELE A2 Spanish exam, using an AI examiner ("Profesora María"). Delevoz is not affiliated with, endorsed by, or acting on behalf of Instituto Cervantes. Feedback you receive is practice guidance generated by AI — it is not official DELE scoring, and does not guarantee any outcome on the actual exam.
2. Eligibility
You must be at least 14 years old to create an account. This is Spain's statutory age of digital consent (LOPDGDD Art. 7 sets it at 14, lower than GDPR's default of 16). Under-14 signups are not permitted. By creating an account, you confirm you meet this requirement.
3. Accounts and free sessions
- Creating an account (email address with verification, or Google) gives you one free practice session. There is no way to practice without an account.
- Free credits expire 1 year from the date they are granted, the same rule that applies to purchased credits (§4).
- You agree not to create multiple accounts, use disposable/fraudulent emails, or otherwise attempt to obtain more free sessions than intended. We may suspend accounts we reasonably believe are abusing the free-trial system.
4. Paid sessions
Payment is currently disabled while Delevoz runs as a free proof of concept. This section describes the terms that will apply once purchasing is enabled.
- Sessions are sold as credit packs (Single Session, 3-Session Pack, 5-Session Pack), each credit redeemable for one practice session. This is not a subscription. Credits expire 1 year from the date they are granted (the purchase date, for paid credits). Expired credits are not refunded. Deleting your account forfeits any remaining credits, and you'll be warned of this before deletion completes.
- Payments are processed by Stripe. See the Privacy Policy for what payment data is involved.
- Right of withdrawal: under Spanish/EU consumer law, you'd normally have 14 days to cancel an online purchase of digital content. Because a Delevoz session is designed to be used immediately upon purchase, you will be asked to expressly waive this right at checkout before completing payment. Without that waiver, you may be entitled to a refund on an unused credit within 14 days of purchase.
- Refunds:
- Entirely unused credits may be refunded within 14 days of purchase, on request — offered voluntarily, matching the statutory withdrawal window, since no cost has been incurred on an unused credit. - Once a session has been started, that credit is non-refundable — the underlying AI/voice processing cost is incurred at the start of a session, not its completion. - If a session fails or is unusable because of a Delevoz platform error (not something on your end, like a lost connection), the credit is restored rather than treated as consumed. This is a service-quality guarantee, separate from the buyer's-remorse refund window above.
5. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or to harass, abuse, or attempt to extract harmful content from the AI examiner.
- Attempt to reverse-engineer, scrape, or interfere with the Service's operation, rate limits, or abuse-prevention systems.
- Use session recordings, transcripts, or feedback for purposes other than your own DELE exam preparation, without our permission.
- Misrepresent your identity or exam-taking status.
We may suspend or terminate accounts that violate this section.
6. Intellectual property
The Delevoz name, branding, task prompts, photos, and platform design belong to Cristine Manasan, except third-party content generated via Anthropic and ElevenLabs, which is licensed for use within the Service under those providers' terms. Your own spoken responses remain yours; we process them as described in the Privacy Policy to provide the Service.
7. Disclaimers and limitation of liability
- Delevoz is a practice tool, not a certification, and is not affiliated with Instituto Cervantes. We do not guarantee any particular exam result.
- AI-generated feedback may contain errors. It's guidance, not an authoritative assessment of your Spanish level.
- The Service is provided "as is." To the extent permitted by Spanish law, we are not liable for indirect damages arising from use of the Service, and our total liability for any claim is limited to the amount you paid us in the preceding 3 months.
- Nothing in this section limits liability where it cannot be excluded under Spanish consumer protection law (e.g., liability for gross negligence or willful misconduct).
8. Changes to the Service and these Terms
We may update these Terms as Delevoz evolves; material changes will be reflected in the "Last updated" date above. We may also modify, suspend, or discontinue the Service at any time — this matters in particular during the current proof-of-concept phase, where continuation past the test period is not guaranteed.
9. Governing law
These Terms are governed by Spanish law. No separate courts/jurisdiction clause is included: under mandatory EU consumer-protection rules, a consumer dispute is generally heard in the consumer's own jurisdiction regardless of what a contract specifies, so naming a specific court here wouldn't be enforceable against a consumer anyway — it isn't needed.
